Terms and Conditions

1. Definitions

• "User": anyone who visits or uses the Marketplace, including buyers, renters and agency staff.
• "Agency": a real-estate business with an agency account on the Marketplace, and its owners, managers and agents.
• "Listing": a property advertisement published by an Agency, including its text, photos, price and other details.
• "Content": anything a User or Agency submits, including listings, messages, reports, photos and documents.

2. The Marketplace's role

The Marketplace is an online platform where Agencies advertise property for sale and rent and where buyers and renters can contact them. We are not a party to any sale, lease, reservation, deposit or other agreement between you and an Agency or property owner, and we do not act as your agent, broker or adviser, unless Bangkok Real Estate is itself the advertising Agency for a Listing.

We do not own, inspect or guarantee any property advertised by other Agencies. Any transaction is solely between you and the Agency or owner.

3. Eligibility and accounts

• You must be at least 18 years old and able to enter into a binding contract to create an account.
• You sign in with one-time codes sent to your email address. Keep your email account secure; you are responsible for all activity on your account.
• Provide accurate information and keep it up to date. One person may hold one account.
• You may delete your account at any time in Account → Profile. We may suspend or close accounts that break these Terms or the law, or to protect other Users.

4. Listings and property information

• Listings are created by Agencies, which are solely responsible for their accuracy, completeness, legality and availability, including price, size, photos, ownership status and terms.
• Prices and availability can change without notice. Information is for general guidance and is not an offer capable of acceptance.
• Some Listing text is machine-translated from the Agency's original. Translations may contain errors; the Agency's original wording prevails.
• Maps may show an approximate location. Distances and walking times are estimates.
• Always view the property, verify the owner's title and the Agency's authority, and read any contract before paying a deposit or signing. Foreign buyers should take advice on ownership rules under Thai law.

5. Agency verification

We check that each Agency is a registered business before its Listings can be published. Verification confirms the business's registration and contact details at the time of checking only. It is not an endorsement or a guarantee of the Agency's conduct, any property, price or statement, and it does not replace your own checks.

6. Agencies' obligations

• Agencies must provide true and complete company information and documents, and tell us promptly of changes.
• Agencies warrant that they are authorised by the owner to market each property, that each Listing is accurate and current, and that their Listings and conduct comply with Thai law, including consumer protection, advertising, personal data and land and condominium ownership rules.
• Agencies must remove or update a Listing promptly once the property is no longer available or its details change.
• Agencies must not put phone numbers, links or other contact details in Listing text or photos, or post duplicate, misleading or bait listings.
• Agencies handle buyer and renter personal data they receive through the Marketplace as independent data controllers and must use it only to respond to the enquiry.
• Agencies are responsible for their staff's use of their account.

7. Licence to your Content

You keep ownership of Content you submit. You grant us a non-exclusive, worldwide, royalty-free licence, for as long as the Content is on the Marketplace and for a reasonable period after, to host, display, reproduce, resize, translate, format and distribute it on the Marketplace and in promoting the Marketplace (for example in search results and social media). You confirm you have the rights needed to grant this licence, including in all photos.

8. Messages and reports

• Messages you send through the Marketplace go to the Agency that advertises the Listing, with your name and contact details. Agencies may keep them for their records.
• Use messages only for genuine property enquiries. Don't send spam, harassment or unlawful content.
• We may review messages, Listings and reports to keep the Marketplace safe, investigate abuse and comply with the law.

9. Prohibited conduct

• Posting false, misleading, discriminatory, defamatory, obscene or unlawful Content.
• Impersonating any person or business, or misrepresenting your authority to market a property.
• Scraping, copying, framing or reusing Listings, photos or data, or using automated tools to access the Marketplace, without our written permission.
• Interfering with or trying to bypass the Marketplace's security, rate limits or verification.
• Using the Marketplace for fraud, money laundering or any unlawful purpose.

10. Moderation, suspension and removal

We may, at our discretion and without prior notice where needed, review, refuse, hide, edit the display of or remove any Listing or Content, request changes, and suspend or terminate any account or Agency that we reasonably believe breaks these Terms or the law, or puts Users at risk. We will usually tell the affected Agency why.

11. Plans and fees

Listing is free during the launch period. Paid plans, listing credits, boosts or other paid services may be introduced later; we will publish their prices and terms before any charge applies, and no Agency will be charged without agreeing to them.

12. Partner offers and third-party links

Partner offers are provided by third parties who are solely responsible for them, their terms and their fulfilment. Links to third-party websites, WhatsApp or LINE are provided for convenience; we are not responsible for their content or practices.

13. Intellectual property

The Marketplace's design, software, logos, trademarks and compilation of data belong to us or our licensors. Except for Content you own, you may not copy, modify or distribute any part of the Marketplace without our written permission.

14. Disclaimers

The Marketplace is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranty that it will be uninterrupted, error-free or secure, or that any Listing, translation or information is accurate, complete or current.

15. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, data, deposit or opportunity, arising from your use of the Marketplace, any Listing, or any dealings between you and an Agency, owner or partner. Our total liability to you for any claim is limited to the fees you paid us in the twelve months before the claim, or THB 1,000 if you paid none. Nothing in these Terms limits liability that cannot be limited under Thai law, including your rights as a consumer.

16. Indemnity

Agencies agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from their Listings, Content, conduct or breach of these Terms or the law.

17. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new date and, for significant changes, notify account holders by email. Continued use after the changes take effect means you accept them.

18. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute will be subject to the exclusive jurisdiction of the courts of Thailand in Bangkok, without affecting any mandatory rights you have as a consumer.

19. General

• If any part of these Terms is found unenforceable, the rest remains in effect.
• Our failure to enforce a provision is not a waiver of it.
• These Terms are available in English and Thai. If they differ, the English version prevails.
